Privacy Policy

  • The identification of “[b]rowser type, IP address, and browsing patterns, collected via cookies and similar technologies” as non-personal information is not correct. This is considered to be personal information.
  • We also want to ensure that any information communicated to you is covered in this notice as well (e.g., contents in an email or website submission).
  • The notice should disclose from whom information is received (e.g., directly from the individual or through tracking technologies/cookies).
  • Under section 2, it states that Wear-Con will send marketing communication “if you have opted in.” Individuals in the United States do not have to opt into such communications, so this should be corrected. They do have the ability to opt out though, and this should be addressed somewhere in the notice.
  • The disclosure section should include more information about who information will be shared with. For example, it should list affiliates/subsidiaries (if applicable), disclosures in the event of a legal obligation, and disclosures in the event of a merger/acquisition.
  • There should be more robust disclosures regarding the cookies you use and their purposes.
  • There should be a section that addresses your retention of personal information and what factors you consider when retaining personal information.
  • There should be a disclosure that the site is not for children under the age of 13.
  • The privacy “Your Rights” section should give individuals information on how they can opt out of marketing communications.
